TERMS AND CONDITIONS
I. Tender form /BOQ can be downloaded by the original contractor available on LG& RDD website ( www.lgkp.gov.pk). The tender will be conducted through E-Bidding
system introduced vide notification No. AO-I/LCB/Estt:/19-6/2017, dated,19/06/2017.
II. The following documents are required to be submitted with the tender form.
i. Earnest Money to the extent of 2% in shape of call deposit in favor of TMO Adenzai is required to be submitted
ii. PEC Enlistment copy and renewal with LCB for the year 2021-2022.
iii. Attested CNIC copy of bidder.
III. The bidder if found with bogus documents, their tender will be rejected and Their case will be recommended for black listing.
IV. Contractor/ firm can write clearly their rates above / below/ at par both in words and digits.
V. Any cutting / over writing on the BOQ will be liable to rejection of the tender and will be declared non responsive.
VI. Sealed tender envelops having name of contractor and name of work will be reached on same date i.e. 27/04/2022 up to 11:30 AM along with duplicate copy for submission to the office of Secretary LCB Peshawar. No form will be recieved through Fax or by Hand.
VII. The contractors quoting their bids up to a limit of 15% below Engineer estimate shall submit bid security to the extent of 2% of Engineer Estimate only.

The contractors quoting their bids more than 15% below on Engineer’s Estimate shall submit along with their bids an Additional Security to the extent of their bid/rates more than 15% below on engineer estimate in the form of percentage.

In case the bidder quotes more than 15% below the Engineer Estimate and the bid is not accompanied by the Additional Security then the bid shall be considered as non-responsive and the 2nd lowest bidder and so on will be considered accordingly.

In case a contractor quotes more than 30% below on Engineer Estimate, the procuring entity shall, in addition to additional security, require the contractor to produce detailed rate analysis of his bid price in relation to any or all the items of bill of quantities, scope of work, allocation of risks and responsibilities and/or any other requirements of the bid solicitation document. The contract shall be awarded to the lowest evaluated bidder who has satisfied the procuring entity on rate analysis. However, if the procuring entity determines that the contractor has failed to demonstrate its capability to execute the contract at the offered price, the matter shall be referred to the next higher authority for rejection of the bid on the basis of being financially unviable.

The procuring entity may offer the contract to next lowest bidder after due diligence in the context of financial difference between such two bids or may advertise procurement opportunity afresh.
After commencements of work by the successful bidder, the procuring entity may replace the Additional Security with a bank guarantee of the same amount from the scheduled bank; if the already deposited security is not in the form of bank guarantee. According to the provincial Government Notification, 2.5% Overhead charges have been added in the PC-I Estimate and there will be no objection to any contrator. All the rates will be on MRS 2021.
VIII. The test of concrete or any other construction material if any shall be performed on the risk and cost of contractor desired by the Engineering in-charge.
IX. Incomplete application/ tender form should be ignored.
X. All other term/ conditions can be obtained from the office of Engineering branch TMA Adenzai during office hours/ working days.
XI. If governments announce vacation on tender date the tender will be open in next working day & same time.
XII. Tender form must reach on the same day till 11:30 A.M and will be opened in same day at 1:00 PM in the presence of contractors.
XIII. Payment to the contractor will be made as and when release by the government.
XIV. The work could not be sublet to any other contractor.
XV. All the Taxes will be deducted as per rule.
XVI. The Officer/Incharge may reject or accept the tender with valid reason.
