1)    Sealed Tender based on MRS-2021 Contractors followed the new provincial Government rules under the Notification No. MRS Cell/C&W/6-1/D&S/2019-20 Dated 01-10-2019 keeping in view the mentioned notification the contractors shall quote their rates (ONLINE) as Above/Below.

2)    Tender forms will be received till 10:30 am and opening of tender will be at 11:00 am on dated 02/03/2022 at office of TMA Town-II, Peshawar.

3)    All the bidding will be through E-bidding system. Tender form and BOQ can be filled and downloaded by the original contractor available on the official website of LCB (www.lcbkp.gov.pk) Khyber Pakhtunkhwa after one day of publishing of NIT in newspaper.

4)    The contractors are required to fill the tender form and BOQ online and submit a hard copy of the same tender form to the office of TMA Town-II, Peshawar. The original and duplicate copies of tendered documents clearly marked as original and duplicate in the name of Administrator/TMO Peshawar respectively (sealed in one envelop) must be submitted to the office of TMA Town-II, Peshawar. The tender document must reach this office up to fixed date and time as mentioned.

5)    The following documents must be attached with bids:

             (i) Enlistment and Renewal Copy in Local Council Board for the Year 2021-22

 (ii) Photocopy of CNIC

(iii) Power of Attorney (if applicable).

(iv) Valid Photocopy of Pakistan Engineering Council (PEC)

6)    Tender documents of bidders if found with bogus/false documents will be rejected and their registration shall stands cancelled/blacklisted in addition of forfeiture of earnest money and security amount (if any).

7)    No tenders are acceptable through Fax/by hand. Sealed bids sent through registered mail/couriers service should reach up to the specified time and date, and will be opened in presence of bidders/representatives.

8)    All contractors / firms are bound to mention rates as per notification No KPPRA/M&E/Esst: /1-5/2016” Above/Below system”.

9)    The contractors quoting their bids up to a limit of 15% below Engineer Estimate shall submit bid security to the extent of 2% of Engineer Estimate only.

10) The contractors quoting their bids more than 15% below on Engineer’s Estimate shall submit along with their bids an Additional Security to the extent of their bid/rates more than 15% below on engineer estimate in the form of percentage.

11) In case the bidder quotes more than 15% below the Engineer Estimate and the bid is not accompanied by the Additional Security then the bid shall be considered as non-responsive and the 2nd lowest bidder and so on will be considered accordingly.

12) In case a contractor quotes more than 30% below on Engineer Estimate, the procuring entity shall, in addition to additional security, require the contractor to produce detailed rate analysis of his bid price in relation to any or all the items of bill of quantities, scope of work, allocation of risks and responsibilities and / or any other requirements of the bid solicitation document. The contractor shall be awarded to the lowest evaluated bidder who has satisfied the procuring entity on rate analysis. However, if the procuring entity determines that the contractor has failed to demonstrate its capability to execute the contract at the offered price, the matter shall be referred to the next higher authority for rejection of the bid on the basis of being financially unviable.

13) In case the bid becomes a tie the contractor shall be decided through a free toss which shall be binding and final.

14) The time limit of each work shall be as per work order issued to successful bidder and the contractor will have to start the work within 15 Days’ time period after the issuance of Work order failing which the Contract will be cancelled and security/additional security  ( if any ) will be forfeited.

15) The successful contractor will execute an agreement with the department within 15 days in which all amendments must be included so far.

16) All federal and provincial duties/stamp duty and taxes including sales tax will be recoverable as per directives of the government issued from time to time.

17) TMA Town-II, Peshawar may reject any or all bids after communicating the reasons for rejection at any time prior to the award of contractor.

18) Any addition made in terms & Conditions in the NIT advertised in the newspaper will be implemented as per KPPPRA Rules.

19) The contractor who offered their bids online but do not sent the hard copies or incomplete/ defective documents will be debarred from tendering process of TMA     Town-II, Peshawar, in the future and their case will also be send to the competent forum for blacklisting.

20) As per Additional Chief Secretary Khyber Pakhtunkhwa Planning & Development Department Civil Secretariat Peshawar (Infrastructure Section) Notification No. Chief/INF/P&D/003-02/2022/01 dated 3rd January, 2022:-

i)      All the interested eligible bidder shall deposit their call deposit receipt (CDR) in the name of procuring entity five days prior to the closing date of bid submission.

ii)     The procuring entity shall ensure that the bids of only those bidder be opened whose security deposit has been credited to their official account before opening of bids.

iii)    In case, no security deposit is credited, the bid shall be considered non responsive and shall summarily be rejected.

21) All bidders are required to be registered with the Khyber Pakhtunkhwa Revenue Authority, established under the Khyber Pakhtunkhwa Finance Act, 2013(Khyber Pakhtunkhwa Act No. XXI of 2013), for works consulting & non-consulting services as listed in Schedule-II of the Act ibid.

Work order will be issued after provision of fund.
