e-Bidding System

Terms and conditions :-

1) All the bidding will be through E-bidding system. Tender form and BOQ can be filled and downloaded by the original contractor available on the official website LG & RDD. DG Office (www.lgkp.gov.pk) Khyber Pakhtunkhwa after publishing of NIT in newspaper.

2) The Contractors are required to fill the tender form and BOQ online and submit a hard copy of the same tender to the office of the Assistant director LG & RDD Malakand, the original and duplicate copies of tendered documents clearly marked as original and duplicate in the name of the concerned Nazim VC/NC and Assistant director LG & RDD Malakand respectively (seal one envelope) must be submitted to the Concerned AD office. The tender document must reach this office up to fixed date and time as mentioned.

3) The following documents must be attached  with bids:                                                                                            

(i) Enlistment and renewal copy LG & RDD for the year 18-19.                                                                                                                                                                  

(ii) Photocopy of CNIC                                                                                                                                                                                                                                                                                                               

(iii) Power of Attorney ( if applicable )                                                                                                                     

(iv) Pakistan Engineering Council ( PEC )  in the relevent category/ specification codes                                                                                                                                                                    

4) Tender documents of bidders if found bogus / false documents will be rejected and their registration shall stand cancelled / black listed in addition of forfeiture of earnest money and security amount ( if any )

5) No Tenders are acceptable through Fax/by hand. Sealed bids sent through registered mail /courier services should reached up to the specified time and date. The contractor or his representative may be present at the time of opening of tender.

6) Any contractor/firm are bound to mention rates as per notification No KPPRA/M&E/Estt:/1-5/2016"above / below system"

7) The contractors who quote their rates more than 10% below the engineers estimate shall submit an additional security in the form of call deposit equal to 8% of estimated cost in the name of concern VC NC Nazim. After commencement of work by successful bidder 8% call deposit may be replaced with bank guarantee of the same amount from scheduled bank.

8) 8% additional security of the successful bidder shall be forfeited in case the successful bidder repudiates the contract or fails to submit the performance guarantee.

9) The procuring entity shall evaluate the difference b/w the quoted rates by the lowest bidder and second lowest bidder on basis of the general principle of economy. If the difference is more than forfeited amount of additional security of successful bidder the contract shall not be awarded to the second lowest bidder and the procuring opportunity shall be advertised afresh keeping in view general principle of public procurement as enshrined under section of KPPPRA Act 2012. 10) The contractors who offer their bids online but do not send the hard copies or incomplete/defective documents will be debarred from tendering process of Directorate General LGRDD in the future and their case will also be send to the competent forum for blacklisting.

11) In the case the bid becomes a tie the contractor shall be decided through a free toss which shall be binding and final.

12) The time Limit of each work shall be as per work order issued to successful bidder. Contractor will have to start work within 15 days’ time period after the issue work order failing which the work will be cancelled and security/additional security (any) will be forfeited.

13). All federal and provincial duties / stamp duty and taxes including sales tax recoverable as per direct use of the government issued from time to time.

14). The procuring entity may reject any or all bids after communicating the reason for rejection at any time prior to award of the contract.

15). Any addition made in term and condition in the NIT advertised in newspaper implemented as per KPPRA rules.

16) As per KAPPRA notification No.KAPPRA/M&E/ESTT:1-12/2017-18 the bid security of the invited bidder shall submitted in shape call deposit receipt from the account of concerned contractor, no pay order are acceptable.

17) All bidders are required to be  registered with the Khyber Pakhtunkhwa revenue authority, established under the Khyber Pakhtunkhwa finance Act.2013 (Khyber Pakhtunkhwa Act No XXI of 2013),for works, consulting and non-consulting services as listed in scheduled-II of the Act ibid.

18) Any bidder who quotes more than 25% below rate is required to submit the Rate analysis along with deposit of the additional security at the ratio of per percent additional amount added to the 8% security within 15 days positively failing which the 2% security of the concerned Bidder shall be forfeited and the Bid will be awarded to the next lowest Bidder following the same criteria, in order to level sufficient protect the P.E against Financial loss.
