  1. All the bidding will be through e-bidding system. Tender form and BOQs can be filled and downloaded by the original contractor available on official website of LG&RDD, DG Office Khyber Pakhtunkhwa after 2 days of publishing of NIT in daily newspaper.
  2. The contractors are required to fill the tender form online and BOQ online and submit a hard copy of the printed form to the office of Assistant Director, LG&RDD Shangla. The original and duplicate copies of the tendered form clearly marked as original in the name of Concerned Village Council Nazim and duplicate in the name of Assistant Director LG&RDD Shangla, must both be submitted to the Assistant Director LG&RDD Office Shangla.
  3. The tender forms must reach to the Office of Assistant Director LG&RDD Shangla up to fixed date and time mentioned.
  4. The following documents must be attached with the bids: (i) Enlistment in LG&RDD for the year 2018-19 (ii) Copy of CNIC (iii) PEC Registration copy (iv) Power of attorney (if applicable)
  5. Tender documents of bidders if found bogus/false documents will be rejected and their registration shall stand cancelled/black listed in addition of forfeiture of earnest money and security amount (if any).
  6. No tenders are acceptable through fax/by hand. Sealed bids sent through registered mail/couriers service should reach up to the specified time and date. The contractor or his representative may be present at the time of opening of tender
  7. Any contractor/firm are bound to mention rates as per notification No.KPPRA/M&E/Estt:/1-5/2016 “Above/Below system”.
  8. The contractors/bidders who quote their bids/rates more than 10% below the engineer’s estimate shall submit an additional security in the form of call deposit equal to 8% of the estimated cost in the name of Concerned Village Council Nazim.
  9. The additional security shall be released to the contractors in four installments i.e. 25% to be released after completing 25% of the project, 50% to be released upon 50% completion, 75% to be released upon 75% completion and the remaining amount to be released after completion of the project. In case of bidder quotes more than 10% below the estimated cost and the bid is not accompanied with the additional security then the bid shall be considered as non-responsive and the 2nd lowest bidder and so on will be considered accordingly with applicability of rule#03 sub rule (2).
  10. The item rate system is replaced by Above/Below system on BOQ based on MRS applicable. All tenders shall be processed according to “Above/Below System” based on market rate system, in case of donor assisted projects, the procurement guidelines of the Donor Agency, where required under International obligation, shall be forwarded in all issues related to procurement of works.
  11. In the case the bid becomes a tie the contractor shall be decided through a free toss which shall be binding and final.
  12. The time limit of each work shall be as per work order issued to successful bidder and the contractor will have to start the work within 15 days’ time period after the issuance of work order failing which the work will be cancelled and security/additional security (if any) will be forfeited.
  13. All Federal and Provincial duties/stamp duty and taxes including sales tax will be recoverable as per directives of the government issued from time to time.
  14. The procuring entity may reject any or all bids after communicating the reasons for rejection at any time prior to the award of contract.
  15. Any addition made in terms & conditions in the NIT advertised in the newspaper will be implemented as per KPPRA Rules.
  16. The 2% Earnest Money for the work shall be submitted in shape of original online call deposit/CDR from the schedule bank of Khyber Pakhtunkhwa in the Name of Concerned Village Council Nazim.
  17. Unauthorized persons will not be allowed to participate in the tender process
  18. The executing agency reserves the rights to reject any bid by assigning cogent reason under KPPRA rule no.47.
  19. The rules/regulations of Govt. of Khyber Pakhtunkhwa, issued time to time will be strictly abide
  20. The tender will be opened in the office of Assistant Director LG&RDD Shangla.
  21. All contractors must be registered with Khyber Pakhtunkhwa Revenue Authority established under the Khyber Pakhtunkhwa, Finance act 2013. (Khyber Pakhtunkhwa Act No. XXI of 2013), for works consulting and non-consulting services as listed in the Schedule-II of the Act bid.
  22. The successful bidders will submit the material testing report from any approved laboratory especially in the concrete works, no payment will be admissible without material testing report of concrete and other items.
  23. The contractor should complete the scheme as per time period mentioned in work order otherwise a penalty should be imposed for late completion.
  24.  The contractors who offered their bids online but didn’t sent the hard copies or incomplete/defective documents, will be debarred from tendering process of DG LG&RDD in the future and their case will also be send to the competent forum for blacklisting.
  25. In case of any dispute or grievances of the bidders, the decision will be made as per section-35 of the Khyber Pakhtunkhwa Procurement Act – 2012 and no other involvement will be admissible as per section-35 and the decision of the KPPRA will be final.
